Terms of Use

Welcome to Stratified Learning.

These Terms of Use (“Terms”) govern your access to and use of the Stratified Learning platform, websites, and services (“Services”). By accessing or using our Services, you agree to these Terms.

If you do not agree, you must not use the Services.

1. About Us

Stratified Learning provides a suite of educational tools designed to support curriculum planning, professional learning, and governance in education.

2. Eligibility and Accounts

To access certain features, you must create an account.

You agree to:

  • Provide accurate and complete information

  • Maintain the security of your login credentials

  • Notify us immediately of any unauthorised use

You are responsible for all activity under your account.

We reserve the right to suspend or terminate accounts where misuse, unauthorised access, or breaches of these Terms occur.

 

3. Acceptable Use

You agree to use the Services only for lawful and appropriate purposes.

You must not:

  • Use the Services in a way that breaches any law or regulation

  • Upload or share harmful, offensive, or inappropriate content

  • Attempt to gain unauthorised access to systems or data

  • Interfere with the operation or security of the Services

Where the Services are used in educational settings, you must ensure that any student or sensitive data is handled in accordance with applicable privacy laws and institutional policies.

 

4. Intellectual Property

All content, software, and materials within the Services are owned by or licensed to Stratified Learning.

You are granted a limited, non-exclusive, non-transferable licence to use the Services for their intended purpose.

You must not copy, modify, distribute, or reverse engineer any part of the Services without prior written consent.

** User Content
Users retain ownership of all content they create or upload to the Services. By using the Services, users grant Stratified Learning a limited, non-exclusive licence to use, store and process such content solely for the purpose of providing and improving the Services. Stratified Learning does not use user content for any other purpose without permission.

 

5. Data and Privacy

We are committed to protecting user data.

Your use of the Services is also governed by our Privacy Policy, which outlines how we collect, use, and store personal information in accordance with Australian privacy laws.

Stratified Learning handles personal information in accordance with applicable Australian privacy laws.

By using the Services, you acknowledge and agree to the handling of your data as described in our Privacy Policy.

6. Use of Third-Party Services

Stratified Learning uses trusted third-party providers to deliver aspects of the Services, including:

  • Application hosting and deployment platforms

  • Managed database, authentication, and storage services

  • Network and security infrastructure

These providers may process or store data on our behalf. We select providers that maintain appropriate technical and organisational security controls.

Stratified Learning retains control over application design, data governance, and access management.

7. Use of Artificial Intelligence

Stratified Learning incorporates artificial intelligence (AI) technologies to support content generation, curriculum development, and user workflows.

AI-generated outputs are provided as assistive tools only and are not intended to replace professional judgement. Users are responsible for reviewing, validating, and determining the suitability of all generated content before use.

Stratified Learning applies structured safeguards and design constraints to guide the quality, relevance, and appropriateness of AI-generated outputs. However, we do not guarantee the accuracy, completeness, or fitness for purpose of AI-generated content.

Users must ensure that any use of AI-generated content complies with applicable laws, institutional policies, and professional standards, particularly in educational contexts.

8. Service Availability

We aim to provide reliable access to the Services but do not guarantee uninterrupted availability.

We may:

  • Update or modify the Services

  • Perform maintenance

  • Suspend access where necessary for security or operational reasons

 

9. Limitation of Liability

To the maximum extent permitted by law, Stratified Learning is not liable for any indirect, incidental, or consequential loss arising from use of the Services.

Nothing in these Terms excludes or limits rights under the Australian Consumer Law.

10. Termination

Stratified Learning may suspend or terminate access to the Services where there is a breach of these Terms or where required for security or operational reasons. Where practicable, users will be provided with notice.

You may stop using the Services at any time.

11. Use by Students

The Services may be used by individuals under the age of 18 where access is provided through a school or with appropriate consent from a parent or guardian.

12. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

Any disputes arising from these Terms or the use of the Services are subject to the jurisdiction of the courts of New South Wales.

 

13. Changes to These Terms

We may update these Terms from time to time.

Updated versions will be published on our website with a revised effective date. Continued use of the Services constitutes acceptance of the updated Terms.

AI Content Indemnity Clause 

Intellectual Property and AI-Generated Content

Stratified Learning provides AI-generated content as an assistive tool to support users. While reasonable steps are taken to reduce the risk of inappropriate or infringing content, AI outputs are generated dynamically and may not always be free from error or similarity to existing works.

Indemnity

Subject to the terms set out below, Stratified Learning agrees to indemnify and hold harmless the Customer and its authorised users (including staff, educators, and students) against any third-party claim that AI-generated content provided through the platform directly infringes copyright or moral rights.

Conditions of Indemnity

This indemnity applies only where:

  • The AI system is used in accordance with its intended purpose

  • Users comply with all applicable terms of use and acceptable use policies

  • The content has not been modified in a way that contributes to the alleged infringement

  • The claim arises directly from the AI-generated output provided by the platform

 

Exclusions

This indemnity does not apply to:

  • Content that has been edited, adapted, or combined with external materials by the user

  • Use of the system outside its intended educational or operational purpose

  • Inputs provided by users that introduce infringing material

  • Any third-party content incorporated or referenced by the user

 

Limitation of Liability

Any indemnity provided under this clause is subject to the following limitations:

  • Liability is capped at the total fees paid by the Customer in the preceding 12 months

  • Stratified Learning’s liability excludes indirect or consequential loss

 

User Responsibility

Users are responsible for reviewing and validating AI-generated content prior to use, including ensuring that content is appropriate, accurate, and compliant with applicable laws and policies.
